What is a “Pauper’s Affidavit”?

 

A pauper’s affidavit is simply a tenant that says to the court after a ruling that they would like to appeal but can’t due to financial constraints. It’s used to supposedly delay the process, but as I always say you can’t stay forever. The tactic does buy a little time, but usually not enough to go through the process. What’s surprising to me is that if the tenant spent that time packing and moving they could avoid additional charges and fees. I’ve personally never had anyone file a pauper’s affidavit in 30+ years of doing evictions.
